By Breaking Belize News Staff: A 35-year-old Belize City construction worker accused of stealing a sack of electrical wires from his uncle and threatening him with a machete has had the theft charge withdrawn after a magistrate found insufficient evidence to support it.
Fitzroy Elijah Brown appeared unrepresented in the Belize City Magistrate’s Court this week, charged with theft and aggravated assault upon his uncle, 45-year-old mechanic Egbert Brown.
According to court reports, the incident occurred on October 24, when Egbert received information that his nephew was allegedly cutting wires at his garage on Fabers Road.
Egbert told police that when he arrived, he spotted Fitzroy riding away on a bicycle carrying a white sack. Upon noticing his uncle, Fitzroy allegedly abandoned the sack and fled.
Egbert reportedly pursued his nephew, who allegedly pulled out a machete and pointed it at him twice.
In court, Fitzroy initially pleaded guilty to theft but explained that he had collected the wires and other discarded materials from a bushy, vacant lot, insisting he did not know they belonged to his uncle.
“I never knew it was for him,” Brown reportedly told the court.
The magistrate entered an equivocal plea on his behalf after his explanation contradicted an admission of theft.
After reviewing the prosecution’s facts, the magistrate pointed out that the evidence did not establish the elements of theft and suggested that attempted theft would have been the more appropriate charge.
The police prosecutor subsequently withdrew the theft charge, leaving only the aggravated assault allegation.
Fitzroy pleaded not guilty to aggravated assault, claiming it was his uncle who had pulled a machete from his bicycle during their confrontation.
With no objection from the prosecution, Brown was granted bail of $2,000 plus one surety of the same amount.
His bail conditions prohibit him from contacting or interfering with his uncle, require him to remain at least 100 yards away, and mandate that he report to the Raccoon Street Police Station every Wednesday.
However, before processing bail, Brown was required to settle an outstanding $430 court debt stemming from a previous conviction for threatening words.
He is scheduled to return to court on November 30, 2026.
