By Breaking Belize News Staff: Ervin Middleton, 49, on Wednesday was sentenced to 17 years, 10 months, and 27 days in prison for the rape of a 13-year-old child. Justice Nigel Pilgrim handed down the sentence, emphasizing the severe psychological harm inflicted upon the victim and the critical need to protect vulnerable children.
Middleton, who was convicted in April of this year, had consistently denied the charges, maintaining his innocence. However, Justice Pilgrim classified his actions as a Category 2 offense, highlighting the significant age difference between Middleton and his victim – over 30 years – and the profound abuse of trust. The judge described Middleton as “a predator hunting a prey,” underscoring the premeditated nature of the crime and his disregard for the law.
During the sentencing, Justice Pilgrim stressed the court’s responsibility to send a clear message: “Children are vulnerable, they must be protected, and the Court must send a clear message, that a person in position of trust of a child who uses that trust to harm a child, and if they touch them, they will end up in jail.”
The court considered several factors in determining the sentence, including the mandatory sentencing range for rape, which for a victim under 14 years old, carries a minimum of 15 years and can extend to life imprisonment. Justice Pilgrim initially set a starting point of 17 years, two years above the mandatory minimum, due to the aggravating factors and the victim’s age.
Aggravating factors that led to an additional two years included a level of premeditation, Middleton’s knowledge that the child’s guardian might not believe her, and his previous convictions for wounding and harm, which occurred after the rape allegations. This brought the sentence to 19 years.
Mitigating factors, such as testimonies from good character witnesses who spoke of Middleton as a hardworking father and friend, led to a deduction of one year, reducing the term to 18 years. A further deduction of 33 days for time served on remand (from September 15, 2022, to October 18, 2022) resulted in the final sentence of 17 years, 10 months, and 27 days, backdated to April 7, 2025, the day of his conviction.
A victim impact statement, read in court, revealed the profound suffering endured by the minor, who expressed feeling “down and hopeless especially not having the support of her own mother.” The child was separated from her family for her protection, and her academic performance suffered as a result of the trauma.
Justice Pilgrim also mandated that Middleton undergo counseling, medical, and psychiatric treatment while incarcerated and is prohibited from changing his address upon release.
Middleton was found guilty on Monday, April 7, 2025. The victim, who was 18 when she testified in camera, recounted how Middleton, who was living in the house at the time, raped her despite her pleas and attempts to resist, telling her that her mother would not believe her. Middleton’s defense maintained that the child fabricated the story out of revenge after he ended a relationship with her mother due to a familial relation.
