Belize High Court dismisses contempt claims against Tracy Panton

By Aaron Humes: In a significant ruling, the Belize High Court has dismissed contempt claims filed by Moses “Shyne” Barrow against Tracy Panton. This decision comes as the nation gears up for the March 12 general elections, adding a layer of complexity to the ongoing dispute within or between the United Democratic Party (UDP) and the factional Alliance for Democracy.

The court’s ruling did not address the contentious issue of UDP leadership, which has been a point of contention since Barrow’s claims arose. In its clarification, the court stated that a prior order from November, which aimed to revert operations to their previous state, specifically pertained only to the occupation of the UDP headquarters located on Youth for the Future Drive in Belize City.

The case revolved around two major applications. The original contempt application filed last year sought a potential three-month prison term for Panton, while a subsequent application aimed to impose a gag order preventing her and her associates from commenting on UDP matters. However, both applications were unsuccessful, with the court denying the injunctive relief request. Consequently, Panton and her associates have been awarded costs.

Panton reaffirmed her commitment to the party, stating, “We have always maintained that we are members of the United Democratic Party and we are running as candidates of the United Democratic Party.” She emphasized that the October 20, 2024, National Convention saw delegates overwhelmingly support her position as interim leader, with 70 percent endorsing her leadership until after the general elections.

On the other hand, Barrow acknowledged the complexity of the situation but insisted, “Nothing has changed,” referring to the operations at the UDP headquarters. He pointed out that the other side appeared to concede that the matter is about free speech, and that Panton’s comments do not interfere with his role as party leader.

While there is no interim restraining order currently in place to prevent such comments, Barrow noted that they could seek damages if they prevail at trial. Panton also highlighted the unity within the UDP, stating that there are 31 candidates elected at conventions, except for one constituency committee – Barrow’s own in Mesopotamia – that has requested a new standard bearer.

The court’s ruling opens the door for a heated election season, with the leadership challenge question still pending resolution and Taegar-Panton has indicated she will attend next week’s pre-election meeting hosted by the Elections and Boundaries Department.
