By Zoila Palma Gonzalez: On Monday, Tracy Panton and supporters including John Saldivar visited the UDP headquarters with the intent to occupy the offices and carry on the work of the party.
Police were also at the offices since they attempted to occupy the upper part of the building where Shyne Barrow has his office.
Today, John Saldivar explained that the trustee of the property authorized Tracy Panton to control the UDP headquarters.
“The land in question wherein lies the UDP headquarters is therefore held by Philippa Bailey in trust for the UDP. Under trust law, Phillipa Bailey remains the trustee until she signs over the land to another trustee or by an order of the Court.
A trust cannot ever be without a trustee and a trustee cannot be canceled or revoked without the outgoing trustee signing over to a new trustee or by an order of the Court.
Philippa Bailey has never signed the trust over to anyone else and she is still the trustee on record no matter how much Shyne etal kick and scream and the trustee has authorized Hon. Tracy Panton etal to take control of the UDP Headquarters,” Saldivar explained.
However, Saldivar says that the trustee has no obligation to go to the Court to get her rights enforced.
“Chester Williams is wrong and acting outside his jurisdiction. He has turned Trust Law on its head and this perversion will be shown in Court if he insists. The trustee knows her rights and will be vindicated by a judicial review of Chester Williams’s decision. The police will have to retreat from this private property,” Saldivar further claimed.
