By Breaking Belize News Staff: The trial within a trial (voire dire) in the case of former police corporal Elmer Nah, 40, continued yesterday in the High Court before Justice Nigel Pilgrim, with the focus on police body camera footage of a house search conducted at Nah’s Belmopan residence on New Year’s Eve, 2022.
Police officer Jerome Middleton, who led the search, testified as the court viewed three of four video recordings showing the hour-long sweep of Nah’s home. The footage revealed officers searching room by room while Nah and his wife filmed with their phones. Nah’s daughter was also present, asleep in one of the rooms.
Defense attorney Dr. Lynden Jones cross-examined Middleton for nearly three hours, questioning the legality of the search. He highlighted that the search warrant was only read to Nah at 12:30 a.m. on New Year’s Day, 2023—outside the hours permitted on the document. The defense argued that this discrepancy rendered the search unlawful.
During the search, police seized items including a headlamp allegedly used in the murders and a battle dress uniformbelonging to Nah. Jones objected to the seizure of the headlamp, noting no warrant had been presented to confiscate it.
The proceedings also heard evidence regarding Nah’s medical condition. A KHMH doctor’s report dated Oct. 1, 2025, classified his recent injury as “harm”, noting mild conjunctival congestion and astigmatism in his left eye. Nah claims he was pepper-sprayed in prison, leaving him with impaired vision.
The trial resumed this afternoon with further testimony, including the fourth video of the search. The prosecution is expected to call IT experts tomorrow, with FBI personnel and the lead investigator scheduled to testify virtually next week.
Nah is on trial for a triple murder that occurred on Dec. 31, 2022.
