Trademark Rules Amended Prohibiting Registration of Political Party Symbols

The Attorney General’s Ministry, in collaboration with the Belize Intellectual Property Office (BELIPO), is pleased to announce that the Trademarks Rules have been officially amended by Statutory Instrument No. 90 of 2025 to prohibit the registration of political party symbols as trademarks. This important legal reform was made by the Minister responsible for Intellectual Property under the authority of section 71 of the Trademarks Act. It represents a significant step in safeguarding Belize’s political heritage and ensuring the integrity of its democratic processes.

The amendment to the Trade Marks Rules now expressly bars the Registrar of Intellectual Property from accepting trademark applications that include political party symbols. This addresses a critical gap in the previous legal framework, which did not contain any specific prohibition against such registrations. As a result, private individuals, or entities with no affiliation to a political party, could have potentially registered a party’s symbol, name, or emblem as a trademark for commercial or other purposes, thereby undermining the political party’s identity and confusing the electorate.

Prior to this amendment, the legal status of political parties further complicated matters. Since political parties in Belize are not recognized as legal entities under the Companies Act or other legislation, they were unable to directly register their own marks. This created an opportunity for third parties to exploit political party identities by filing for registration of symbols commonly associated with parties and using them in connection with services such as political consulting, fundraising, or public engagement.

Under the amended rules, a “political party symbol” is now defined to include any insignia, emblem, flag, seal, logo, design, or name that has been used for at least ten years and is associated with a political party that has fielded candidates in elections under the Representation of the People Act or relevant local government legislation.

The Attorney General’s Ministry emphasizes that this reform does not interfere with the lawful use of trademarks in commerce. Rather, it reinforces the principle that political identity is not a private asset to be commercialized, but a vital part of Belize’s democratic fabric. The Ministry and BELIPO remain committed to fostering a modern, fair, and principled intellectual property system, one that protects both public interest and the foundational values that guide the nation’s democratic life.
