By Breaking Belize News Staff: Three Southside Belize City men have been remanded to the Belize Central Prison after being charged with the offense of promoting a gang activity—a charge that falls under the Crime Control and Criminal Justice Act, which restricts the Magistrate’s ability to grant bail.
Arraigned separately but charged with the same offense were Jason Horace Anderson, 27, a mechanic of Ben Bow Street; Ervin Nimrod Fitzgibbon, 36, a fisherman of Ben Bow Street; and his younger brother, James Fitzgibbon, 28, of the corner of Kraal Road and Cut Avenue.
The trio appeared before Magistrate Ludlow Black in Court #5 around 2:34 p.m. on Thursday, escorted in by police. Each man pleaded not guilty to the charge.
According to police, Anderson was allegedly seen in a photo flashing a Bloods gang sign dating back to 2017. Ervin Fitzgibbon is accused of displaying a sign associated with the Supal Gang, while James Fitzgibbon allegedly posed with a Bloods hand sign in a separate image.
Despite Anderson’s claim in court that the image used against him is over seven years old and that he explained his actions to police, Magistrate Black informed all three accused that under Section 16-1-A of the Crime Control and Criminal Justice Act, the court is not authorized to offer bail. He advised them that they are free to apply to the High Court.
The men have been remanded until their next court date set for June 16, 2025, when police are expected to provide disclosure in the case.
