By Aaron Humes: The imprisoned Ryan Joseph Budna has filed a lawsuit against several key government figures and law enforcement officers, alleging serious violations of his constitutional rights through what he describes as unlawful abduction. The case was officially submitted today by Budna’s legal team, which includes attorneys Arthur Saldivar, Michelle Trapp, and Emmertice Anderson.
The lawsuit names prominent defendants, including the Attorney General, Police Minister Kareem Musa, Police Commissioner Richard Rosado, and Constable Barry Flowers. Additionally, two officers involved in what is characterized as the abduction team are included, alongside two police corporals who reportedly encountered the alleged abductors during their lawful duties on the night in question.
Budna’s suit seeks a court declaration affirming that his arrest was unlawful and that he suffered torture, denial of assistance, and kidnapping. The complaint also states that he was unlawfully expelled from Belize to Guatemala. Among the requests is a demand for the Belizean government to facilitate Budna’s return through “legal and diplomatic means” and to conduct a full inquiry into the circumstances surrounding his extradition.
Moreover, the lawsuit is seeking damages and costs, emphasizing the severe impact of the alleged violations on Budna’s rights and well-being.
While attorneys Saldivar and Trapp opted not to comment on the suit at this time, the filing underscores growing tensions between citizens and government authorities regarding the protection of constitutional rights.
The Prime Minister awaits a report from the Belize Police Department into its investigation into Budna’s alleged abduction due by the end of the month, repeating that his decision is based on what they give him. No timeliness has been set for a hearing on the new action.
