Regional Judicial and Legal Services Commission responds to allegations surrounding Caribbean Court of Justice

By Zoila Palma:  The Regional Judicial and Legal Services Commission (RJLSC) has issued a statement addressing recent allegations concerning the administration of the Caribbean Court of Justice (CCJ) and the independence of its judges.

The statement comes amid an internal dispute at the region’s highest court, following leaked emails in which five of the six sitting judges reportedly raised serious concerns about CCJ President Winston Anderson’s leadership, including allegations of dictatorial rule, panel-fixing and administrative overreach.

The controversy reportedly began with a unilateral proposal concerning a new judicial dress code but escalated into broader concerns about the administration of the Court, including the removal of Justice Chile Eboe-Osuji from a hearing panel.

Senior judges have reportedly warned that the dispute could threaten the independence and impartiality of the regional court.
In its August 10 statement, however, the RJLSC said it is aware of the allegations and recognizes “the seriousness of these matters and the importance of addressing them in a manner that protects public trust and confidence in the Court.”

The Commission, which was established in 2003 under the Agreement Establishing the Caribbean Court of Justice, stressed that it is an independent, non-political body responsible for appointing CCJ judges and staff, determining their terms and overseeing disciplinary action.

The RJLSC said it has operated independently for more than two decades, maintaining that its Commissioners have “enjoyed fruitful working relationships with the Court” and have functioned without interference from the Court or external actors.

The RJLSC also urged caution in drawing conclusions about the allegations before they have been properly examined. “No conclusions should be drawn about the allegations until they have been examined fairly and objectively,” the Commission stated, adding that it remains committed to its independent operations.

The Commission said it believes concerns surrounding the CCJ and RJLSC can best be addressed through established internal governance mechanisms and a transparent, independent review.
