By Aaron Humes: 24-year-old Everald Sambula was released after the High Court declined an application to allow a fearful witness to give testimony against him remotely in connection with a daring robbery in 2018.
Sambula, one of several persons believed to have carried out the armed robbery of Premium Wines and Spirits on Newtown Barracks in October 2018 which netted almost $60,000 in cash and personal items, had a nolle prosequi entered against him by the Crown on Thursday.
The case had been called up for trial which was set to commence before a jury of 9, 5 men and 4 women who were selected to hear the case but the Crown Counsel submitted that a fearful witness did not wish to come to court. High Court Justice Candace Nanton ordered that the witness must appear in court after hearing the matter in chambers. After the motion of nolle prosequi, the jury was dismissed and Sambula was let go as well.
Sambula, the only person to have been charged in the case, faced five counts of robbery against employees of the company and customers. The robbers took advantage of a customer entering the premises to storm in themselves and hold up the employees and customers present to a tune of $57,785.25. He was represented by defense counsel Leeroy Banner.
