Police constable remains under fire: Department reviewing Philip Garbutt’s fitness to continue

By Aaron Humes: The footage of police constable Phillip Garbutt allegedly engaging in domestic abuse has ignited a firestorm of public outrage and scrutiny, despite the dropping of one criminal charge against him. The video, surfaced widely on social media, has prompted new headaches for his employers the Belize Police Department, putting focus on Garbutt’s suitability for continued service in law enforcement.

Garbutt was previously placed on interdiction when charges were filed against him in February, but with the emergence of the video, police officials are now re-evaluating the circumstances surrounding the case. Assistant Superintendent Stacy Smith addressed this escalating situation, acknowledging the profound impact the footage has had on public perception and trust in Garbutt specifically and the police generally: “I will admit that now there’s a new dimension because it is in the public realm and calls are being made. I say this because it is important for us as police officers to be able to command the confidence of those persons with whom we serve, and given that the video has made waves on social media and persons are aware of who he is, that certainly calls into question his ability to continue gain the confidence of the public when it is that he’s conducting his duties so that definitely creates a new dimension and we are reviewing that to see how best to approach the situation.”

ASP Smith affirmed that every police officer is held to a higher standard, particularly those in positions of authority. “Given that the matter has gone as viral as it has and it is now in the public domain, persons in the public, and I cannot fault them for feeling that way, are of the view that he cannot continue as a police officer…I believe, every right thinking person would be of the same opinion in that the conduct is one that cannot be countenanced, children are vulnerable, women are vulnerable and they should be protected and especially so when you hold an office such as being a police officer you are certainly held to a higher standard,” she stated. She further noted that at least part of Garbutt’s disciplinary charges could result in his dismissal if convicted; that matter continues.

Further, ASP Smith emphasized that while individuals may wish to stop court action, the state ultimately bears responsibility as the victim of the crime. In cases involving minors, additional layers of legal procedure must be followed to ensure the child’s protection.

The case has been referred to the Office of the Director of Public Prosecution, and there are indications that the prosecution will move forward based on the evidence available, particularly the video footage. Smith expressed confidence that the gravity of the situation would warrant a thorough review by the DPP office and supported the reinstatement of charges if deemed appropriate.
