By Aaron Humes: The Office of the Director of Public Prosecutions has discontinued proceedings against 26-year-old Leeroy Bardalez of Belize City after entering a motion of nolle prosequi in the High Court on Monday.
The Fabers Road Extension area resident, represented by Arthur Saldivar, heard the news from High Court Justice Nigel Pilgrim, although the motion means the case is discontinued only because of insufficient evidence available at this time.
Of the Crown’s two main witnesses, one refused to testify and the other could not be located by police.
Bardalez was charged exactly three years ago at the age of 22 with the murder of Ricky Miguel and injury to Thalia Westby on Fabers Road on September 7, 2020, during a shooting incident. Bardalez had initially been charged with murder, attempted murder, use of deadly means of harm and dangerous harm.
