No re-trial for Denfield Lemmott whose burglary conviction quashed but sent back to jail for other burglary charge

By Breaking Belize News Staff: High Court Justice Candace Nanton has ruled that there will be no retrial for Denfield Lemott, whose conviction and eight-year prison sentence for burglary were recently quashed on appeal, effectively making him a free man in that matter.

Lemott was convicted in July 2025 for burglarizing the home of a general manager and his wife in 2024, during which $2,520 in cash and jewelry were stolen. However, in a ruling delivered in late December, Justice Nanton found Lemott’s conviction to be unsafe and set aside both the conviction and sentence.

On Friday, Justice Nanton informed Lemott that she would not order a retrial, stating that “it would be unfair given the circumstances of the case.”

Despite the ruling, Lemott was returned to the Belize Central Prison later that evening, as he is facing another burglary allegation for which he had previously been denied bail. He will be required to apply for bail either in the Magistrate’s Court or the High Court in that pending matter.

Lemott had been found guilty on Thursday, July 31, 2025, and sentenced to eight years’ imprisonment, with nine months deducted for time already spent on remand, leaving a remaining sentence of seven years, two months, and eight days to be served at the Belize Central Prison.

The burglary occurred on Friday, March 17, 2024, at a residence located at Mile 5 on the Philip Goldson Highway. Police received a report around 7:30 p.m. from a Belizean general manager, who reported that his home had been broken into sometime between 6:45 a.m. and 7:10 p.m.

Surveillance footage from the residence showed a man later identified as Denfield Lemott entering the home through the main door. Following investigations, police executed a search at Lemott’s residence, where a Brazilian gold chain was recovered. The homeowner later positively identified the chain as one of the items stolen during the burglary.

Lemott was first arraigned on the burglary charge on Tuesday, May 28, 2024, at which time he was denied bail and remained on remand until his conviction was overturned.
