No independent investigation into Joseph Budna’s alleged abduction: P.M. to recommend sending police file to Director of Public Prosecutions

By Aaron Humes: Prime Minister John Briceño has stated that there will be no independent investigation into the abduction of Joseph Budna, a move that raises questions about the transparency of the investigation process. Instead, the Prime Minister has decided to send the investigative file directly to the Director of Public Prosecutions (DPP), which may mean more investigation by the same police force that has been involved from the beginning.

“I think we’re coming to the consensus that, quite likely, and I will make their recommendation tomorrow to Cabinet, I think it’s better then, time to just pass it on to the DPP and let them deal with it,” he told reporters on Monday.

Briceño highlighted that, according to Attorney General Anthony Sylvestre, there’s no existing law that would allow for an independent investigative body to be formed, suggesting that perhaps future legislation could be considered. He noted, “Maybe that’s something that we have to take a look for the future.”

The issue is complicated by historical precedent; while there is currently no law for a special investigator, there have been instances in the past where special prosecutors were appointed to handle similar high-profile cases.

Asked why the issue is not being given any importance by Government because a Belizean citizen is in a Guatemalan prison, the P.M. said dismissively, “That’s your word. So, yeah.”

Budna has launched a Constitutional challenge against his removal in the Belize High Court but has not been heard from since he first challenged the results of the investigation led by Assistant Commissioner Suzette Anderson in September – investigations which supposedly cleared Commissioner of Police Dr Richard Rosado of any involvement but did not shed light on who may have been involved beyond one officer, Barrington Mai or Barry Flowers.
