By Zoila Palma: A senior vice president of Super Micro Computer Inc. and two associates have been charged with conspiring to smuggle billions of dollars’ worth of computer servers containing advanced chips from Nvidia to China, according to an indictment filed in Manhattan federal court.
U.S. officials allege the scheme violated U.S. export control laws between 2024 and 2025, AP reports.
Prosecutors say the defendants used fabricated documents, staged equipment to pass audits, and relied on a pass-through company to conceal the true destination of the servers and their client base.
James C. Barnacle Jr. described the methods as deliberate attempts to evade oversight, while U.S. Attorney Jay Clayton said the alleged actions pose a direct threat to national security.
Those charged include Yih-Shyan “Wally” Liaw, 71, a U.S. citizen and senior vice president of the company, and Ting-Wei “Willy” Sun, 44. Liaw was released on bail following his arrest in California, while Sun remains in custody pending a bail hearing. A third suspect, Ruei-Tsang “Steven” Chang, a Taiwan-based sales manager, remains at large.
Court filings allege Liaw and Chang directed executives of a Southeast Asian company to order approximately $2.5 billion in servers from Super Micro Computer, with at least $510 million ultimately diverted to China after being assembled in the United States. The scheme is said to have escalated in scale over time.
