By Breaking Belize News Staff: After nearly four weeks behind bars, 39-year-old former police officer Brigilio Ack is appealing his conviction for sexually assaulting a female colleague and is seeking bail while his appeal is pending.
Ack, who served 19 years in the Belize Police Department, was convicted on August 15, 2025, for sexually assaulting a fellow officer at the Rocky Road Police Booth in 2023. The victim testified that Ack touched her legs, squeezed her breasts, and kissed her against her will while they were on duty. He was sentenced to eight months in prison, with the court stressing that as a serving officer at the time, he “ought to have known better.”
Today, Ack’s attorney, Rachel Montejo, asked the Senior Magistrate to grant a stay of execution and bail pending the appeal, arguing that Ack is not a flight risk, has deep ties to Belize, and faces reputational and financial ruin if he remains imprisoned while awaiting a potentially lengthy appeal process. She also insisted his case has strong grounds for success.
The prosecution countered that Ack’s case does not present any “special circumstances” to justify bail, citing precedent in which bail pending appeal was denied, and stressed that no evidence was provided to show delays in the appeal process.
The Senior Magistrate reserved her decision until next Friday, September 19, 2025.
Ack, visibly anxious in court, remained silent during his original trial, where he was unrepresented. The female officer testified in camera that the assault occurred during a night shift on March 20, 2023.
For now, Ack remains incarcerated as he waits to learn if he will be released on bail while challenging his conviction.
