Fisherman charged under Cyber Crime Act for sharing woman’s nudes

By Breaking Belize News Staff: A 25-year-old woman has become the latest victim under the Cyber Crime Act after explicit videos of her were shared without her consent. The footage showed her partially nude and being molested while she was asleep.

Charles Patrick Herbert, 43, a fisherman has been charged with the crime after a police investigation.

After spending the weekend in police custody, Herbert appeared unrepresented before a Senior Magistrate in Court #3 on Monday morning. He was read three criminal charges: sexual assault, transmitting images of a private area, and intentionally capturing images of a private area.

According to police reports, on February 15, 2025, Herbert intentionally touched the victim’s left buttocks in a sexual manner without her consent. When the first charge was read, Herbert pleaded not guilty with an explanation. However, the Senior Magistrate advised that since he pleaded not guilty, no explanation was necessary at that time. He also pleaded not guilty to the other two charges related to capturing and transmitting explicit images without consent.

Police allege that Herbert used a cellphone to record and distribute footage of the victim’s buttocks and genitalia without her permission. The victim discovered the videos on February 21, 2025, after visiting the home of her current common-law husband. He had received a WhatsApp message from a number she recognized as belonging to Herbert. The message contained two videos: one lasting 48 seconds and another lasting 25 seconds, both showing the victim asleep, partially undressed, and being touched inappropriately.

The victim stated that she had no knowledge of Herbert entering her home, nor did she give consent for him to record or touch her. Following her report, police launched an investigation, gathering statements and securing Herbert’s cellphone as evidence.

Although the prosecution raised no objections to bail, the Senior Magistrate set Herbert’s bail at $5,000 with one surety of the same amount, which he met before 2:00 p.m. today. However, strict conditions were imposed: he must not communicate or interfere with the victim, her family, or prosecution witnesses, whether directly, indirectly, or via social media; he must stay at least 25 yards away from the victim’s home, workplace, or any location she frequents; he is prohibited from possessing, obtaining, or sharing any images of the victim and any breach of these conditions will result in bail revocation.

Herbert is scheduled to reappear in court on April 28, 2025, as the case progresses.
