By Aaron Humes: The trial of 27-year-old Dane Gillett for the 2021 killing of Dwayne Darwin Gabourel, a 15-year-old student of St. John’s College (High School) in Belize City began last Wednesday and will be paused for the holidays and the end of the legal year.
Gillett, represented by Orson Elrington, is accused of shooting Gabourel on September 27 while he was buying at a neighborhood shop; the teenager died three days later. Director of Public Prosecutions Cheryl-Lynn Vidal, Senior Counsel, is prosecuting before High Court Justice Derrick Sylvester.
The Crown has closed its case against Gillett after testimony from 30 witnesses, although only two testified in open court. Elrington will prepare a submission for no case to answer against his client when the case resumes on January 27, 2025.
Justice Sylvester ordered Elrington to file his arguments to the court by December 12, and the DPP is to file her submissions in response by December 23. Elrington then has until January 6, 2025, to reply to the Crown’s response and a decision will be given after oral submissions when the case resumes.
The prosecution’s case is that Gillett attacked Gabourel, mistakenly, in retaliation for the murder of Michael Henry. The teenager was wearing a red shirt when he came under fire but was not known to be affiliated with any gang. He was a promising student with a bright future cut short by being in the wrong place at the wrong time
Evidence before the court includes circumstantial evidence and video footage capturing the murder, which shows Gabourel being shot at the store by a gunman who jumped off a motorcycle and opened fire – however his face was fully covered to attempt to conceal his identity.
The trial will continue in 2025.
