Caribbean Court of Justice denies urgent application from Ramlogan in election dispute; Court of Appeal to decide whether to hear case before election day

By Aaron Humes: In a significant ruling, the Caribbean Court of Justice (CCJ) rejected an urgent application submitted by Senior Counsel Anand Ramlogan on behalf of his client, Jerry Enriquez, who is seeking to delay the upcoming March 12 elections. Enriquez contends that the current state of the voters list is unconstitutional and poses a threat to the integrity of the electoral process.

During a virtual case management conference on Monday, the Court of Appeal deliberated on the application for special leave to appeal against a previous decision made by High Court Justice Tawanda Hondora but ultimately decided it needed further time to decide, promising a speedy hearing date.

In a surprising maneuver, Ramlogan attempted to bypass the Court of Appeal’s process by filing with the CCJ, seeking a reversal of the case management orders. Legal experts noted that this unprecedented move to challenge the court’s guidance is uncharted territory in the region’s legal landscape.

However, after careful consideration of the legal framework under the Caribbean Court of Justice (Appellate Jurisdiction) Rules, 2024, the court found the application to be without merit. Consequently, it ordered that the application be dealt with on the papers, officially denying the request for special leave.

In addition to the ongoing electoral challenges, Ramlogan has aligned himself with the Roody Wade/Belize Peace Movement election challenge, which is set to be heard in the High Court today, Tuesday, just eight days before Election Day.

Senior Counsel Eamon Courtenay, representing the Election and Boundaries Commission as a defendant in the case, will address the press this afternoon on the ramifications of today’s outcome.
