By Aaron Humes: Police accosted a Belize City man ‘hanging out’ on the street side and said he had to leave. When he refused, they charged him with loitering, but as they took him to the police mobile, he decided to leave after all.
The difference for 29-year-old Jermaine Wagner, a fisherman of Sarstoon Street, Belize City, is that he was lawfully detained in the second instance.
Days later police caught up to him, and on Thursday he was arraigned in Magistrate’s Court with loitering and escape from lawful custody.
Police say that on Wednesday, November 27, Wagner was caught loitering at the corner of Santa Barbara and Mahogany Streets by a police mobile patrol and did not move away when requested to do so by Police Sergeant Jacinto Roches after twice being warned, saying he was “just talking.” After Sergeant Roches detained him and he was being escorted into the police mobile, he is accused of endeavoring to prevent Sergeant Roches from executing the law by escaping from lawful custody while being detained for loitering.
Wagner pleaded guilty to both charges and asked the sitting Senior Magistrate to have mercy on him as he had a son to care for and a job to go to and he can pay of the court impose a fine.
As it was his first offense and he pleaded guilty the court elected to fine and not confine him, but pointed out that he could have avoided either charge if only he had listened to the warning of the officer.
It will cost him $550 total and court costs due by January 31, 2025, in default five months imprisonment total.
However, Wagner owed previous fines to the court and had to make payment to avoid being sent to Hattieville right away.
