‘Tired-body’ trespasser sent back to jail to sleep after trying to take nap on Simon Quan’s balcony

By Breaking Belize News Staff: A Mahogany Heights resident who admitted to trespassing on private property in downtown Belize City is behind bars; not for the new offense, but for an old court debt he was unable to pay.

34-year-old Alton Nicholson, a construction worker and part-time salesman, appeared before a Senior Magistrate on Tuesday morning and pleaded guilty to trespassing on the premises of a Queen Street businessman on Saturday, November 29, 2025.

Nicholson told the court he had no intention to commit any crime and only entered the property because he was exhausted.

“I was just tired… I was exhausted why I went there to sleep,” Nicholson explained, adding that he had recently been released from prison and would not repeat such behavior.

The Magistrate, noting his remorse and lack of previous convictions for similar offenses, imposed a fine of $100 plus $5 cost of court, giving him until January 16, 2026 to pay. In default, he faces two weeks in prison.

Despite the leniency shown for the trespassing charge, Nicholson was unable to walk free. Court records revealed he owed $450 on an old fine dating back to 2008, stemming from a matter he was required to settle by 2009 but never completed.

The Senior Magistrate ordered him to pay $250 toward the outstanding balance by the end of the day. Nicholson, unable to raise the money, was escorted to the Belize Central Prison.

The court indicated it may grant him an extension to clear the remaining balance, but only after he pays the required $250.

According to police reports, on December 1, 2025, the businessman reported that at around 10:21 p.m. on November 29, he saw a man standing on the second-floor balcony of the Simon Quan Compound while he was walking his dog. The businessman stated he and his grandmother had given no one permission to be on the property.

Nicholson was detained by police and later charged with trespassing.

He remains incarcerated until he can meet the court’s payment requirement.
