International News: United States court strikes down President Trump’s global tariffs

By Rubén Morales Iglesias: In a major legal setback for United States (US) President Donald Trump, the US Court of International Trade unanimously ruled on May 28, 2025, that the majority of his global tariffs were illegal, blocking their enforcement. The decision, issued by a three-judge panel, sides with Democratic-led states and small businesses that argued Trump misused emergency law to justify sweeping levies.

The ruling affects Trump’s global flat tariff, heightened rates on China, and fentanyl-related tariffs on China, Canada, and Mexico, though tariffs imposed under different legal authorities—such as those on steel, aluminum, and automobiles—remain in place. The court’s decision permanently blocks the tariffs unless an appeals court reinstates them. The Justice Department has already filed an appeal, and the case could ultimately reach the US Supreme Court.

Judges rejected the administration’s argument that the tariffs were legally justified under the International Emergency Economic Powers Act, ruling that trade deficits and drug trafficking did not constitute valid national emergencies under the statute. The court emphasized that Trump’s lawyers had effectively admitted the tariffs were meant to pressure foreign governments into trade negotiations, rather than address an immediate crisis.

Markets responded swiftly to the ruling, with US stock-index futures jumping and the dollar strengthening. White House officials defended the tariffs as necessary to combat unfair trade practices, arguing that the court’s decision improperly limits executive authority.

The ruling marks one of the most significant legal challenges for Trump’s administration, as he faces ongoing lawsuits over other executive actions, including policies on federal employment, citizenship, and government spending.
