By Aaron Humes: He was accused of the July 20, 2023, daylight murder of Nicoli Rhys on Neal Pen Road that prompted a month-long State of Emergency in parts of Southside Belize City.
But David Noel Sutherland, 31, of Custard Apple Street, was informed today in court that the office of the Director of Public Prosecutions had sent a memorandum to the court, directing the court to withdraw the charge of murder against Sutherland for reasons of insufficient evidence to prove the charge gathered by police.
Rhys was ambushed along with another individual while working on his car, unable to outrun the bullets of two gunmen. Sutherland was charged after appearing in court on unrelated drug and firearm charges.
Sutherland pleaded guilty to those chargrd and was sentenced to two three-year prison terms for the gun and ammunition and two months for the drugs, however the Chief Magistrate ordered that the sentences run concurrently instead of consecutively so he will only serve 3 years imprisonment. He continues to serve that sentence.
